Smith: Enforce American Laws and the Constitution

Mar 17, 2004
Press Release

Congressman Lamar Smith, R-San Antonio, today announced his support for a Congressional resolution that urges federal courts to reject foreign law as a precedent in deciding cases. Rep. Tom Feeney and Rep. Bob Goodlatte introduced the resolution.

The House Working Group on Judicial Accountability, of which I am Co-Chairman, was formed last year to expose judicial activism in our nations court system, said Rep. Smith. Judicial activism can be a judge substituting their own opinion for the law or citing foreign law.

Rep. Smith noted that Zimbabwe is a chilling example of the Supreme Courts reliance on foreign law.

In a 1999 capital punishment case, a Justice cited the Supreme Court of Zimbabwe as precedent. Zimbabwe is lead by a brutal dictator, Robert Mugabe, stated Rep. Smith. According to a State Department official, ˜Robert Mugabe has succeeded in reducing a once promising nation with a bright future to a state of ruin, desolation, and isolation."

Last year, after a wave of unprecedented violence, Mugabe warned his opponents that he would crush them like ˜Hitler, ten fold, commented Rep. Smith.
